l. Tom Muehlenbeck Center Landscape and Trail Easement to City of Plano

Purpose: A - Request decision - closure required

Time: No time limit

Description:

The City of Plano is designing a new recreation center on their property adjacent to Renner Middle School. The Board approved a parking/access easement at this location at the October 18, 2005 Board Meeting. The City is planning a continuation of the trails from their site north through the Renner MS fields to Yeary Road. They are requesting a Landscape and Trails easement to accomplish this work. The Trail Exhibit shows the coordination of the easement with the existing Renner MS tennis courts and football field, and the existing fiber optic pull box. The agreement for the previously approved Access and Parking Easements was reviewed for the District by Abernathy, Roeder, Boyd & Joplin, P.C. and coordinated with the attorneys for the City of Plano. This Landscape and Trails Easement is the same language, except for the parts relating to purpose, location and duration. The paragraph on duration has been revised by the Attorneys for the District to allow for future revisions to the easement location. This would allow for flexibility should the District have the need to re-evaluate the use of the property.

Recommendation:

The Administration recommends that the Landscape and Trail Easement be granted to the City of Plano.
