h. McCall Elementary School License Agreement with the City of Plano

Purpose: A - Request decision - closure required

Time: No time limit

Description:

Installation of the second modular classroom building at McCall Elementary School required the relocation of their existing playground equipment. The site at McCall is relatively small (6.41 acres), but is directly adjacent to a City park. The City Parks Department is supporting the relocation of the playground to Park property. This Agreement allows Plano ISD to install playground equipment on City property at Timberbrook Park, directly adjacent to the play area at McCall Elementary School. Also, the location is directly abutting the area of an existing License Agreement for parking executed during the development of the McCall site.

A License Agreement has been negotiated between the City of Plano and Plano ISD. The agreement is scheduled for consideration by the Plano City Council on August 13, 2007. This Agreement has been prepared by the office of Abernathy, Roeder, Boyd & Joplin P.C., and they have coordinated with the City Attorney's office. The legal description of the area has been prepared by a Plano ISD Civil Engineering Consultant and field verified by District staff and the playground equipment installation vendor.

Recommendation:

The Administration recommends that the License Agreement for the construction use and installation of recreational equipment on a portion of Timberbrook Park between the City of Plano and Plano Independent School District be approved.
