Description:

District Policy CH (Legal) authorizes the use of cooperative purchasing to increase efficiency and effectiveness. Texas Government Code Sections 791.003 and Local Government Code 271 grant the legal authority to form and participate in purchasing cooperatives.

Growth of the cooperative necessitates a fiscal agent to provide required administrative support. Lewisville ISD is named as a fiscal agent for administration of the Co-op. An annual administrative fee of $100 is also being added for the fiscal agent. The Education Purchasing Cooperative of North Texas (EPCNT) Interlocal Agreement also requires additional wording to better define the duties of each member school district.

These changes require amending the Interlocal Agreement for the Educational Purchasing Cooperative of North Texas.

Participation is voluntary. The District may elect to participate in none, some, or all bids offered by the Co-op, and may withdraw membership at any time by giving a written notice. Amendment to the Interlocal Agreement for Cooperative Purchasing Educational Purchasing of North Texas is attached.

Recommendation:

The Administration recommends that the Amendment to the EPCNT Interlocal Agreement be approved.
