For the purpose of a private consultation with the District’s attorney when seeking advice about pending or contemplated litigation or a settlement offer, or when the attorney will have an ethical duty of confidentiality.

For the purpose of discussing the purchase, exchange, lease or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person.

For the purpose of considering a negotiated contract for a prospective gift or donation to the District if deliberation in an open meeting would have a detrimental effect on the District’s position in negotiations with a third person.

For the purpose of considering the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee or to hear complaints or charges against a public officer or employee.

To consider the deployment, or specific occasions for implementation, of security personnel or devices or to deliberate a security audit.

To consider the medical records or psychiatric records of an individual applicant for a benefit from the plan; or a matter that includes a consideration of information in the medical or psychiatric records of an individual applicant for a benefit from the plan.

For the purpose of considering discipline of a public school child or children or to hear a complaint by an employee against another employee if the complaint or charge directly results in a need for a hearing.

For the purpose of deliberating a matter regarding a public school student if personally identifiable information about the student will necessarily be revealed by the deliberation.

To discuss or deliberate regarding commercial or financial information received from a business prospect, or to deliberate the offer of a financial or other incentive to a business prospect.

To discuss or adopt individual assessment instruments or assessment instrument items, or to deliberate a test item.

To deliberate security assessments or deployments relating to information resources technology; network security information as described by Section 2059.055(b); or the deployment, or specific occasions for implementation, of security personnel, critical infrastructure, or security devices.

Section 2059.055(b) reads as follows:

(b) Network security information is confidential under this section if the information is:

1.       related to passwords, personal identification numbers, access codes, encryption, or other components of the security system of a governmental entity;

2.       collected, assembled, or maintained by or for a governmental entity to prevent, detect, or investigate criminal activity; or

3.       related to an assessment, made by or for a governmental entity or maintained by a governmental entity, of the vulnerability of a network to criminal activity.

For the purpose of a private consultation with the District's attorney by telephone conference call.

For the purpose of maintaining the confidentiality of certain information under Texas Government Code sections 418.175 – 418.183 such as information regarding emergency response providers, risk or vulnerability assessment, construction or assembly of weapons, certain encryption codes and security keys for communications systems, certain information provided to the federal government regarding terrorism, critical infrastructure, security systems, and certain information maintained for the purpose of emergency management or disaster planning; however, the Committee must make a tape recording of the proceedings of a closed meeting held to deliberate such information.
